Hi all

I just payed for the new LG smart phone from a seller here on gumtree
his name is Wade S Davis ( St George bank Acc ) and around a month ago there was a HTC Touch phone on --- here. I bought one of them and payed $570 for it and it was delivered no problems the account that was in the name of S J Watson St George acc...

Now just this Monday gone 19/10/2009 I payed into his account Wade S Davis ( St George bank Acc ) $350 now there was 2 days of waiting and no phone all so no phone calls to me about whats going on.. Now Saturday 24/10/2009 I tried again to call his mobile he picked up and told me he was ripped off buy a guy for the phones and that he will sort it out. So he was charged with stolen goods.. Now its Tuesday and I'm still waiting. No calls No phone, And no money... Iv contacted gumtree and police but both can not do much .. PMSL !!!! Go Figure That Aye...

Its my fault for sending money and not getting some other details, I'm OK with that.. I just wanted to let others know that people can sell stolen goods on here and we would not know other wise..

Be like a wood worker Look twice,Measure every thing twice all ways before you cut your timber.. and I did not do this.. I should have asked for more information and be satisfied that I could contact the person with my money and or goods.

BTW: This guy Wade S Davis sounded very nice and I hope he comes good on fixing his mistake. He may have just been ripped off him self.. ?

I just think after a week and nothing done about I should shear it with you all.. Smile

Hi All

Ok just let you know that I received a call today and it could be all good ..

Wade said he is just getting his head together and is paying my money back into my account..

He was a victim of a fake seller..

So the good thing about my post and others like this is to be aware of fake sellers and get all the infoation you can get from them and if ONLY IF your satersfied that you can get your money or goods from that seller..

I will post once I have received the money...

Well the sell payed the money back case closed....

The main thing I have learned is the police and gumtree can not do a lot about our claims so it's intierly up to our self's, ask for every pice of infomation about the seller if that seller dose not give the information you need then more time's than most there a fake..

.....it's become quite apparent to me over a period of time that Gumtree actually DON'T CARE if any of their members have negative issues with buying and selling stuff. I know Gumtree makes it quite clear in their Terms & Conditions that they bear no responsibility for transactions initiated through their site, and that it's up to the buyers and sellers to confirm all the details, but to me at least, that's a real copout!

.....in fact, in a court of law (if it ever came to that!) this argument wouldn't have any legs. Similarly to dry-cleaners and car-parks that deny any liability. Gumtree admin really needs to read up on "implied contracts" whereby "a binding contract can exist between two or more people even where there is NO written agreement or document of any kind, nor a verbal deal." This means that Gumtree could be seen to be complicit in illegal activities in an AUSTRALIAN court by effectively condoning those activities.

.....certainly food for thought.
